1. Acceptance of Terms

These Terms of Service ("Terms") form a binding agreement between you and Finviz ("we", "us", "our"), the operator of the Finviz mobile application and the finviz.site website (together, the "Service"). By installing, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. The App is distributed through Google Play, and your use is also subject to the Google Play Terms of Service. By using the Service, you represent that you meet these requirements.

3. Accounts

  • You can use the App as a guest without an account. Some features (such as syncing across devices) may require an account, which you may create with an email address and password.
  • You are responsible for maintaining the confidentiality of your credentials.
  • You are responsible for all activity that occurs under your account.
  • You must provide accurate information and keep it current.
  • Notify us promptly of any unauthorized use of your account. You can sign out at any time, and you may request deletion of your account by emailing privacy@finviz.site (see our Privacy Policy).

4. Price & Advertising

  • The App is free to download and use and is supported by advertising shown through Google AdMob.
  • We do not currently offer paid subscriptions or in-app purchases. If paid features are introduced in the future, they will be billed through Google Play and governed by Google Play's billing terms, with pricing and renewal details disclosed at the point of purchase.
  • By using the free, ad-supported Service, you acknowledge that advertisements will be displayed within the App.

5. Acceptable Use

You agree not to:

  • Scrape, crawl, or harvest data from the Service except via permitted interfaces.
  • Resell, redistribute, or sublicense the Service or its data without authorization.
  • Reverse engineer, decompile, or attempt to extract source code.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Use the Service for any unlawful or fraudulent purpose.

6. Intellectual Property

The Service, including its software, design, text, and branding, is owned by Finviz and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial purposes, subject to these Terms.

7. Data Accuracy

Quotes, fundamentals, charts, and news are sourced from third-party providers and may be delayed, incomplete, or inaccurate. We make no warranty as to the accuracy, completeness, or timeliness of any data. Do not rely on the Service for time-sensitive trading decisions.

8. No Investment Advice

The Service is an informational and research tool only. Nothing in the Service constitutes financial, investment, tax, or legal advice. See our Disclaimer for full details. You are solely responsible for your investment decisions.

9. Third-Party Services

The Service relies on third-party providers for market data and news (including Finnhub, Yahoo Finance, Alpha Vantage, and CoinDesk), authentication (Appwrite), and advertising (Google AdMob), and may link to third-party content. We are not responsible for the content, policies, or practices of third parties, and your use of them is governed by their own terms. Optionally, you may supply your own market-data API keys; you are responsible for complying with those providers' terms when you do.

10. Termination

We may suspend or terminate your access at any time for violation of these Terms or for conduct we reasonably believe is harmful to the Service or other users. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FINVIZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR TRADING LOSSES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR USD $50.

13. Indemnification

You agree to indemnify and hold harmless Finviz and its officers, employees, and agents from any claims, damages, or expenses arising out of your use of the Service or violation of these Terms.

14. Governing Law & Disputes

These Terms are governed by the laws of the jurisdiction in which Finviz is established, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of that jurisdiction, unless otherwise required by applicable law.

15. Changes to These Terms

We may modify these Terms from time to time. We will post the updated version with a revised "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance.
